By accessing or using the AutoCheck website you agree to be bound by these terms and conditions of use. Pentana Solutions may, with or without notice, terminate, suspend or limit your access to the AutoCheck website if you breach any of terms listed on our website, and reserves the right, in its absolute discretion, to take any action that may be necessary to prevent further access to the AutoCheck website.

What personal information is collected by the AutoCheck website? The AutoCheck website collects personal information to provide you with ability to purchase PPSR and CarHistory reports. Personal information collected by the AutoCheck website includes:

• Credit Card details
• PPSR Certificates or CarHistory Reports that you have purchased

Additional information may be collected/stored by the AutoCheck website. This may include the IP address, the time and date you access our website and the URL that referred you to our website. We may also collect/store information pertaining to your location, ISP, the device you used to access our site, the type of browser and operating system loaded on your device. We may also collect/store any interactions you have with the AutoCheck website including our website features, pages and content that you have accessed and your searching activities. AutoCheck uses Google Analytics service. Google does not collect any personal information, including credit card information that you enter on the AutoCheck website. The Google Analytics tools used by AutoCheck measure and analyse internet usage. Any information collected by Google Analytics does not identify you personally. Google may record information pertaining to your mouse movements and clicks performed on the AutoCheck, your monitor screen resolution, your Internet browser and other additional metrics that are based on website experience.

Where AutoCheck provides information to a third party at your request (for example where you submit an enquiry), you acknowledge that your information will be handled by that third party in accordance with its privacy policy and not in accordance with the AutoCheck privacy policy.

You may request access your personal information that the AutoCheck website holds about you. The information, where permitted by law, can be requested via e-mail at autocheck@registrationsolutions.com.au. Requests will be handled as quickly as possible, however please allow 30 days for a response. Requests may be denied where required or permitted by law. If denied, we will explain why.

Intellectual Property Rights

The Customer must not copy, alter, modify or reproduce the AutoCheck website except to the extent authorised by Pentana Solutions or as expressly authorised under Part III Div 4A of the Copyright Act 1968 (Cth). The Customer must not allow use of, or data extracted from, the AutoCheck website by any 3rd party except with written consent from Pentana Solutions. The AutoCheck website, the trademarks and logos displayed on this Website, remain the property of Pentana Solutions or other third parties. The Customer must not copy, modify or alter the AutoCheck website or merge all or any part of the AutoCheck website with any other software without Pentana Solutions' written permission, or such third party which may own the trademarks and logos. The Customer will fully indemnify against all liability which may be incurred by Pentana Solutions if such modifications or alterations infringe any Intellectual Property Rights of a third person or otherwise cause Pentana Solutions to suffer loss, damages or expense.

Pentana Solutions reserves the right to collect and utilise data from the AutoCheck website for the purposes of aggregated analysis and reporting and guarantee anonymity of the source. In addition to any other remedies available to Pentana Solutions, any unauthorised use, alteration, modification, reproduction, publication, disclosure or transfer of the AutoCheck website will entitle Pentana Solutions to any available equitable remedy against the Customer. The Customer acknowledges that there is no transfer of title or ownership to the Customer of the AutoCheck website or the Documentation or any modifications, updates or new releases of the AutoCheck website.

Warranty

Pentana Solutions shall not be liable for failure of the AutoCheck website due to causes or conditions beyond Pentana Solutions’ reasonable control. If at any time during the Customer believes there is a defect in the AutoCheck Website such that the AutoCheck does not comply with or cannot be used in conformity with the Documentation in all material respects, the Customer must notify Pentana Solutions of such perceived defect. Pentana Solutions will investigate the perceived defect notified and will, upon the verification of the existence of the defect, rectify such defect without additional charge to the Customer.

Pentana Solutions will not be liable to the extent that a defect is caused by the Customer or a third party, including the failure of the Customer or a third party to maintain the operating environment or any part thereof, designated in the Documentation, the failure of a Customer or a third party to maintain the hardware or network, or to otherwise use the AutoCheck website in accordance with recommendations made by Pentana Solutions from time to time, whether in the Documentation or otherwise.

When any hardware or network product is no longer supported or serviced by its supplier and has effectively reached its end of life, the cost of replacement is the responsibility of the Customer. Pentana Solutions' warranty applies only to the functioning of the AutoCheck website and is entirely independent of, and Pentana Solutions is not responsible for, any warranty provided by a third party supplier of hardware or networks that allow the Customer to use the AutoCheck website.

Liability of Pentana Solutions

Pentana Solutions is under no liability to the Customer in respect of any loss or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly in respect of the AutoCheck website and in respect of a failure or omission on the part of Pentana Solutions to comply with its obligations to the AutoCheck website. The Customer warrants that it has not relied on any representation made by Pentana Solutions which has not been, stated expressly on the AutoCheck website, or upon any descriptions, representations, illustrations or specifications contained in any document including catalogues or publicity material produced by Pentana Solutions.

The Customer acknowledges that to the extent Pentana Solutions has made any representation which is not otherwise expressly stated, the Customer has been provided with an opportunity to independently verify the accuracy of that representation. The Customer at all times indemnifies and holds harmless Pentana Solutions and its officers, employees and agents (those indemnified) from and against any loss (including reasonable legal costs and expenses) or liability reasonably incurred or suffered by any of those indemnified arising from any proceedings against those indemnified where such loss or liability was caused by:

• A breach by the Customer of its obligations under this Agreement;
• Any wilful, unlawful or negligent act or omission of the Customer.

Governing Law

This Agreement will be governed by the law of Victoria. The parties irrevocably submit to the exclusive jurisdiction of the Courts of Victoria and the Federal Court of Australia in that jurisdiction, and the Courts of appeal from them. No party may object to the jurisdiction of any of those Courts on the ground that it is an inconvenient forum or that it does not have jurisdiction.
